This Privacy and Personal Data Processing Policy is a public Agreement entered into between the owner of the website https://topmed.kz
TopMed LLP, hereinafter referred to as the "Operator", and the "User". This Privacy Policy is based on Law of the Republic of Kazakhstan N 94-V "On Personal Data and their Protection" dated 21 May 2013 and applies to all information that the "Operator" may receive about the "User" while using the website https://topmed.kz

The current version of this Privacy Policy is available on the Internet at https://topmed.kz/privacy_policy at all times.


1. Definition of terms
1.1. "Website" means the website located on the Internet at https://topmed.kz. All exclusive rights to the Website and its individual elements (including software, design) belong to the Operator in full. The assignment of exclusive rights to the User is not subject to this Privacy Policy.

1.2. "Site Administration" means authorized employees to manage the Website, acting on behalf of TopMed LLP, who organize
and/or carry out the processing of personal data, as well as determine the purposes of personal data processing, the composition of personal data to be processed, the actions (operations) performed with personal data.
1.3. "User" means a person using the Website .
1.4. "Laws" means the current legislation of the Republic of Kazakhstan.
1.5. "Personal data" means personal data of the User, which
the User provides on their own during registration or while
using the functionality of the Website.
1.6. "Non-personal data" means information that is automatically transmitted in the process of viewing ad units by the User and when visiting pages on which the system statistical script (pixel) is installed.
1.7. "Personal data processing" means any action (operation) or set of actions (operations) performed with or without the use of automation with personal data, including the collection, recording, systematization, accumulation, storage, clarification (update, change), extraction, use, transfer (distribution, provision, access), anonymization, blocking, removal, destruction of personal data.
1.8. Website Services means the combination of services available for use on the Website.
1.9. Registration means the completion of the Registration Form
on the Website by the User by entering the necessary information and sending
the scanned documents.
1.10. Registration Form means the form on the Website that
the User must complete in order to be able to use the Website in its entirety.
1.11. Confidentiality of personal data means a mandatory requirement for the Site Administration or other person who has access to personal data not to allow their dissemination without the consent of the personal data subject or availability of other legal grounds.
1.12. "Operator" is the owner of the Website https://topmed.kz - TopMed LLP.
1.13. Cookies means a piece of data sent by a web server and stored on the User's computer, which the web-client or web-browser sends to the web-server in HTTP-request every time it attempts to open the page of the Site.
1.14. IP-address - the unique network address of a node in a computer network based on the IP protocol.

2. General provisions
2.1. By submitting personal data and other data to the "Operator" via the
"Website", the "User" confirms its consent to the use of said data under the terms set out in this Privacy Policy.
2.2. If the "User" does not agree with the terms of this Privacy
Policy, they must stop using the "Website".
2.3. The "Website" of the "Operator" may contain links to other websites. Please keep in mind that "Operator" is not responsible for the privacy practices of websites that are not operated by "Operator". We encourage you to read the privacy policy of each website that collects any personal information. This Privacy Policy applies solely to information collected by the "Operator".
2.4. The "Operator" does not verify the accuracy of personal data provided by the "User". However, the "Operator" assumes that the "User" provides reliable personal data and keeps this data up to date. All responsibility and possible consequences for providing inaccurate or irrelevant personal data lies with the "User".

3. Privacy Policy Subject Matter
3.1. This Privacy Policy sets out the obligations of
the "Operator" not to disclose and protect the confidentiality of personal data that the "User" provides to the "Operator" when registering on the "Website", or when submitting the form on the website, if any.
3.2. "Personal data" permitted to be processed under this Privacy Policy may include the following information:
3.2.1. surname, first name, patronymic of the "User";
3.2.2. contact phone numbers of the "User";
3.2.3. e-mail address (e-mail);
3.3. The "Website" protects the following "Non-personal data":
3.3.1. IP address;
3.3.2. information from cookies;
3.3.3. information about the browser (or other program that accesses advertising);
3.4. The "Website" collects statistics about the IP addresses of its Visitors. This information is used to identify and solve technical issues.
3.5. Any other personal information not stipulated above (browsers and operating systems used etc.) shall be stored securely and shall not be disclosed except as set out in clauses 5.2. and 5.4. hereof.

4. Purposes for Collecting "Personal Data"
4.1. The "Operator" collects and stores only those "Personal Data" which
which are necessary for the provision of the Services by the "Operator" and the interaction with the "User".
4.2. "Personal Data" may be used for the following purposes:
4.2.1. provision of Services to the "User";
4.2.2. identification of the "User";
4.2.3. interaction with the "User";
4.2.4. sending promotional materials, information and
requests to the "User";
4.2.5. conducting statistical and other studies.
2.3. The "User" is prohibited from providing personal data of third parties on the "Website" (with the exception of the condition of representing the interests of such parties under documented third party's confirmation of such actions).

5. Procedure and Terms of Processing of the "Personal Data"
5.1. Processing of personal data of the "User" shall be carried out without limitation of time, in any lawful manner, including in personal data information systems with or without the use of means of automation.
5.2. The "Operator" shall use the "Personal Data" in accordance with the Law of the Republic of Kazakhstan "On Personal Data and their Protection" and the internal documents of the "Operator".
5.3. The "Operator" may transfer the "Personal Data" and the "Non-Personal
Data" without the "User's" consent to the following parties:
5.3.1. to state authorities, including bodies of inquiry and investigation, and local self-government authorities upon their motivated request;
5.3.2. in other cases expressly provided for by applicable laws of the Republic of Kazakhstan.
5.4. The "Operator" may transfer "Personal Data" to third parties not specified in Clause 5.3. hereof in the following cases:
5.4.1. The "User" has expressed its consent to such action;
5.4.2. transmission is necessary as part of the "User's" use of the "Website"
or the provision of the Services to the "User".
6. Protection of personal data
6.1. The Operator carries out appropriate protection of Personal and other data in accordance with the Laws and takes necessary and sufficient
organizational and technical measures to protect the Personal Data.

7. Miscellaneous provisions
7.1. The laws of the Republic of Kazakhstan shall apply to this Privacy Policy and the relations between the "User" and the "Operator" arising in connection with the application of the Privacy Policy.
7.2. All possible disputes arising from this Agreement shall
be subject to the laws in force at the place of registration of the "Operator". Before applying to the court, the "User" must follow the mandatory pre-action procedure and send the "Operator" a corresponding claim in writing. The time limit for reply to a claim shall be thirty (30) business days.
7.3. If for any reason one or more of the provisions hereof
is deemed invalid or unenforceable, the validity or enforceability of the remaining provisions hereof shall not be affected.
7.4. The "Operator" may at any time unilaterally change the Privacy Policy (in whole or in part) without prior agreement with the "User". All changes are effective from the moment they are posted on the "Website".
7.5. The "User" shall independently monitor changes to the Privacy Policy by reading the current version.
